Acceptance of Terms

These Terms of Use ("Terms") govern access to and use of the JasPing platform and services. By creating an account or using the platform, you agree to these Terms and our Privacy Policy.

JasPing is a B2B SaaS platform intended for use by businesses and professionals. By accepting these Terms, you confirm that you are acting in a professional or commercial capacity, not as a consumer.

If you are accepting these Terms on behalf of a company, you confirm that you have authority to bind that organization to these Terms.

Service Description

JasPing provides a cloud-based platform that enables businesses to deploy AI-powered agents capable of communicating with customers across multiple channels.

Services may include:

  • AI chat and voice assistants
  • Automation of customer interactions
  • Knowledge base integration and management
  • Conversation analytics and reporting
  • Workflow automation and CRM integrations
  • Multi-channel support (WhatsApp, web chat, voice)

We may update, modify, or discontinue features at any time with reasonable notice where such changes materially affect your use of the Service.

User Responsibilities

Users are responsible for:

  • Maintaining the security of their account credentials
  • Ensuring that all data uploaded to the platform is lawful and does not infringe third-party rights
  • Configuring AI agents responsibly and within applicable legal frameworks
  • Informing end-users that they are interacting with an AI agent and not a human
  • Complying with all applicable laws, including data protection laws (GDPR), when deploying AI agents to collect personal data from end-users
  • Obtaining any required consents from end-users before deploying the Service

You remain responsible for all actions performed through your account.

AI Usage & Ethics

You agree not to use JasPing to:

  • Generate illegal, harmful, or misleading content
  • Harass, spam, or deceive users
  • Impersonate individuals or organizations
  • Process personal data in violation of applicable privacy laws
  • Reverse engineer or attempt to extract the underlying models or platform code
  • Use the platform in a way that violates the acceptable use policies of any integrated third-party service
AI responses may contain inaccuracies. Users are responsible for verifying critical outputs before acting on them.

Intellectual Property

Your Content

You retain ownership of all data, documents, and content uploaded to JasPing. You grant JasPing a limited, non-exclusive licence to process your content solely for the purpose of providing the Service.

Platform Ownership

All platform technology, software, interfaces, and underlying AI infrastructure remain the exclusive intellectual property of JasPing. Nothing in these Terms transfers any intellectual property rights in the platform to you.

Feedback

If you provide feedback or suggestions about the Service, you grant JasPing the right to use such feedback without restriction or compensation.

Payment & Subscriptions

JasPing operates on a subscription basis. By subscribing to a plan, you agree to the following:

  • Subscriptions renew automatically at the end of each billing period unless cancelled
  • Usage beyond plan limits may incur additional fees as disclosed in the pricing terms
  • Prices are displayed exclusive of applicable taxes (e.g. French VAT at 20%) unless stated otherwise
  • Billing is managed via Stripe. You authorize JasPing to charge your payment method on record

If a payment fails, JasPing reserves the right to suspend access to the Service until the outstanding balance is settled.

Cancellation & Withdrawal

Cancellation by You

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for the unused portion of a subscription period unless required by applicable law.

Note on Consumer Withdrawal Rights

JasPing is a B2B service intended for professionals. If you are signing up as a business or on behalf of a business, the 14-day consumer right of withdrawal under French consumer law (Code de la Consommation, Art. L221-18) does not apply.

If you believe you are signing up as a consumer (individual, not acting in a professional capacity), please contact us at contact@jasping.com before subscribing to discuss applicable terms.

Termination by JasPing

JasPing may terminate your account with 30 days' written notice, or immediately if you are in material breach of these Terms, without liability.

Effect of Termination

Upon termination, you may request export of your data within 30 days. After this period, your data will be securely deleted in accordance with our retention policy.

Limitation of Liability

JasPing is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service, including fitness for a particular purpose or uninterrupted availability.

We are not responsible for damages resulting from:

  • AI-generated responses or inaccuracies in AI outputs
  • Third-party integrations or service outages
  • Planned or unplanned service interruptions
  • Customer misuse of the platform or misconfiguration of AI agents
  • Loss of data due to failure to maintain adequate backups

To the maximum extent permitted by law, JasPing's total aggregate liability to you for any claims arising out of or in connection with these Terms shall not exceed the total fees paid by you to JasPing in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Data Breach Notification

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms as a data subject, JasPing commits to:

  • Notifying the relevant supervisory authority (CNIL in France) within 72 hours of becoming aware of the breach
  • Notifying affected users without undue delay where the breach is likely to result in a high risk to their rights and freedoms
  • Providing information on the nature of the breach, likely consequences, and measures taken or proposed

As a data processor for your customers' data, JasPing will notify you (the data controller) without undue delay upon becoming aware of a breach affecting data processed on your behalf, to enable you to fulfil your own notification obligations.

Governing Law & Jurisdiction

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

The parties agree to submit to the exclusive jurisdiction of the competent courts of Paris, France to resolve any dispute arising from these Terms, except where mandatory local law requires otherwise.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

For French-speaking customers: In the event of any discrepancy between the English and French versions of these Terms, the French version shall prevail for customers based in France.

Changes to Terms

We may update these Terms periodically to reflect changes in the platform, applicable law, or our business practices.

We will notify you of material changes by:

  • Sending an email to the address associated with your account at least 30 days before the changes take effect
  • Displaying a prominent notice within the platform

Continued use of the platform after the effective date of the updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the effective date.

About Jasping & Google API Usage

Jasping is an AI-powered customer service platform that allows businesses to automatically create an AI agent. The AI agent interacts with customers across WhatsApp, web chat, and voice calls to answer questions, collect leads, and schedule appointments.

Jasping uses Google APIs (Calendar, Drive, Sheets, and Gmail) strictly to provide core features: reading availability to schedule appointments, saving customer-submitted documents to Drive, syncing leads to Sheets, and sending confirmation emails. Jasping does not use your Google data to train AI models.
